The contractual terms between The Kart Shop and those purchasing goods from The Kart Shop are contained exclusively within these Terms and Conditions of Sale. These conditions and the contract shall be subject to and constructed in accordance with the Law of England and Wales.

Variation - No variations to these Terms and Conditions of Sale are permitted unless expressly authorised in writing by The Kart Shop

Liability - It shall be the responsibility of the Purchaser to determine the suitability of the goods for any application. There is no guarantee as to the goods suitability for any specific purpose even if that purpose is known to The Kart Shop. In any dispute that may arise liability of The Kart Shop for breach of any warranty or obligation either expressed or implied is limited to the value of the goods supplied in any event. All recommendations and advice given by The Kart Shop or its employees or agents of The Kart Shop are given without liability on the part of The Kart Shop.

Delivery - Execution of orders is contingent upon the availability of goods and the absence of any circumstances beyond the control of The Kart Shop, which hinder or prevent such execution. The Kart Shop may make delivery by any method of transport available. Risk in the goods shall pass to the purchaser on delivery of the goods to the purchaser.

Delivery delays - Whilst The Kart Shop undertakes that every effort will be made to ensure that goods are delivered promptly, no liability will be accepted for delay in despatch or delivery of goods.

Damage or shortage - Both the carriers and ourselves must be notified in writing within 3 days of receipt of goods, or in cases of non-delivery immediately the invoice is received, otherwise no liability can be accepted. Packages, which have been damaged in transit, should be retained for inspection by ourselves or appointed courier's agents.

Returns and cancellations - Goods properly delivered by The Kart Shop will only be accepted for return or credit subject to our prior consent and if the goods are in the same condition as they were sold. A returns authorisation number must be obtained from The Kart Shop, which must be clearly indicated on any accompanying return note. Any postage costs remain the responsibility of the purchaser. A fee maybe applied for handling.

Retention of title - All goods shall remain the sole and absolute property of The Kart Shop until such time as the Contract price together with any other monies due to The Kart Shop under any Contract are paid.

Payment terms - Payment is made at the time of purchase however All account holders must be paid not later than 30 days from the date of invoice. In the event of default, The Kart Shop reserves the right to charge interest at two per cent above our bank's base rate at monthly intervals on the overdue portion of the account.

Warranties - All items supplied by The Kart Shop are guaranteed against defective materials or workmanship for a period of 12 months from the date of despatch from our warehouse. Any item found to be faulty through defective materials or workmanship will be repaired or replaced at our option. This warrantee does not extend to batteries.

Export orders - Payment must be made in advance. All associated charges must be paid by the purchaser. Freight and Insurance for all export orders is charged at cost. The purchaser is responsible for obtaining any licence and for complying with any regulations in force in the country for which the goods are destined.
